Important advice about your

Work Injury Compensation

These are interesting times in which to discuss work injury compensation. In the recent economy, there has been a subtle shift in favour of employers. With many companies closing and more people out of work, employers can get away with demanding more from their employees and paying less.

Workers who sustain an injury at work are afraid of losing their jobs if they claim compensation. But one thing that is now cast in the law of the land is the employer’s duty of care to his workers. Long gone are the days when employees can be forced to work too long hours, in a badly ventilated, lighted and dangerous workplace.

Also today a multicultural workforce is normal. It is the employer’s responsibility to ensure that regardless of colour, religion, gender, age or preferred football team that each and every employee receives the respect of his fellow workers. Racial or religious discrimination, harassment or workplace bullying are recognised stressors which can lead to depression, stress and in severe cases, suicide.  Any employer who let that continue would be liable of breach of his duty of care.

Work Injury Compensation Procedure

There is always one over-riding principle in personal injury cases, whether they happen at your workplace or on the bus coming home from the shops: no amount of compensation money will ever repay you for a lifetime of discomfort and disability so always tend to your health as the top priority.

Not every physical injury manifests itself with an obvious cut and gushing blood. Back, neck and joint injures may creep up gradually over months. Often work contracts specify that you must attend the company doctor regarding any physical injury received at work but you should also make an appointment with your own GP, who is better able to recognise changes in your physical health or ability.

The time limitation workplace injury compensation cases is usually two years however, if you have sustained an injury at work you would be better to contact a solicitor as soon as possible after the accident. He or she will be better able to collect supporting evidence, documents and witness accounts than if you delay.

Personal injury cases in Ireland, including for work injury compensation are assessed initially by the Injuries Board of Ireland. It is possible for them to make an assessment which you employer accepts with your case never being heard in court. You do not have to engage a solicitor but you have the right to do so, and this what the vast majority prefer to do. (over 90%)

Why is it so important to engage a Solicitor?

Most people have had no experience of work injury compensation claims. They would not know if the assessment handed down by the Injuries Board was fair or not. Many people have accepted the Injuries Board assessment only to find out later that with the level of injury they had sustained, their entitlement should have been higher.

You may name the organisation that employs you and even personally name your boss in your workplace injury compensation claim, but it is really your employer’s insurance company lawyers that will be meeting you in court. It is the insurance company money that those lawyers are trying to protect and they do that by minimising your claim if they possibly can.

Engaging a solicitor will ensure that you know from the start what your entitlement is likely to be, and no matter how experienced the insurance company lawyers are you have a lawyer on your side who is just as experienced, and determined to fight on your behalf.
